Welcome to Flora & Fauna (“we”, “us”, “our”), an eco-tourism travel company operating the website www.florafaunatravels.com (“the Website”). By accessing or using this Website, or by making a booking with us, you agree to comply with and be legally bound by these Terms & Conditions. These Terms, together with our Privacy Policy and any specific booking confirmation, form your agreement (“the Contract”) with Flora & Fauna. If you do not agree with any part of these Terms, please refrain from using the Website or making a booking.
Flora & Fauna specializes in eco-tourism and wildlife travel packages, including nature-based tours, accommodation, transport, and associated services. We work with a network of independent suppliers, including local guides, hotels, transport providers, and conservation partners.
Your booking is confirmed and a contract is formed when we issue a written booking confirmation (via email or through the Website) upon receiving the required deposit or full payment.
By confirming the booking, you:
Warrant that you are 18 years or older and authorized to make the booking.
Accept these Terms on behalf of all travelers listed in the booking.
Agree to provide complete and accurate information.
A deposit or full payment is required at the time of booking, as specified during checkout.
Final balance payments (if applicable) must be received by the date indicated in your confirmation.
Failure to make timely payment may result in cancellation of your booking, and standard cancellation fees will apply.
All payments are processed securely through approved payment gateways. Bank or currency conversion fees are borne by the client.
Prices are quoted in United States Dollars (USD) unless otherwise stated and include government taxes.
Prices published on the Website are subject to availability and may change without prior notice.
Once your booking is confirmed, your price is fixed, except in cases where currency fluctuations, fuel surcharges, or government taxes significantly affect the cost. We will notify you in writing of any surcharges exceeding 2% of your total booking value.
Flora & Fauna takes reasonable measures to safeguard customer payments through secure payment gateways and supplier contracts. In the unlikely event of insolvency, we will make every effort to refund unutilized services or provide equivalent alternatives.
You are responsible for:
Checking all details on your booking confirmation and immediately notifying us of any discrepancies.
Ensuring that all participants hold valid passports, visas, travel insurance, and required health documentation.
Arriving on time at all departure points and following instructions provided by guides or suppliers.
Acting respectfully towards local communities, wildlife, and the environment in line with our sustainability ethos.
Eco and wildlife tours often involve walking, outdoor activities, uneven terrain, and remote locations.
You must be physically fit to participate and disclose any:
Medical conditions, allergies, or mobility limitations, and
Dietary requirements or special requests at the time of booking.
We reserve the right to decline a booking or remove a participant if their health or behaviour endangers themselves, others, or the tour.
Requests to amend bookings must be made in writing. We will do our best to accommodate changes, but:
Amendments are subject to supplier availability and additional charges.
Major changes close to departure may be treated as a cancellation (see Section 10).
Substituting participants requires our prior written approval.
At Flora & Fauna Travels, we understand that travel plans can change. Our cancellation and refund policy aims to be fair and transparent while allowing us to maintain the high quality and reliability of our services.
If you wish to cancel your booking, please inform us in writing (via email) as soon as possible. The following charges will apply based on the number of days before your scheduled tour or travel date:
More than 60 days before departure: Full refund, minus a 5% administrative fee.
30 to 59 days before departure: 50% of the total tour cost refunded.
15 to 29 days before departure: 25% of the total tour cost refunded.
Less than 14 days before departure or no-show: No refund will be issued.
After the tour has begun: No refund will be provided for unused portions such as accommodation, transport, or excursions.
Please note that certain special or promotional rates may be non-refundable, and such conditions will be clearly stated at the time of booking.
We reserve the right to cancel or modify a tour in the event of unforeseen circumstances such as:
Low group participation,
Safety or security concerns,
Natural disasters, strikes, or government restrictions.
In such cases, you will be offered:
A full refund, or
The option to transfer to another date or similar tour of equal value.
Force majeure events (see Section 17).
You will be offered an alternative of equal value or a full refund.
Refunds will be processed within a reasonable timeframe after settlement with suppliers. Bank charges, transfer fees, or currency exchange differences are borne by the traveller. Please note that we are not liable for indirect losses such as visa fees, airfare, or personal expenses.
Requests for changes to your booking (e.g., travel dates, participant details) are subject to availability and may incur an administrative fee. If the revised tour price differs from the original, the balance will be adjusted accordingly.
Comprehensive travel insurance is mandatory.
Your policy must cover medical expenses, personal accident, evacuation, cancellations, and personal belongings. We are not responsible for costs or losses due to inadequate or absent insurance coverage.
Many of the services offered are provided by independent suppliers (e.g. hotels, transport providers, local guides). We act as an agent for these suppliers and accept no liability for their acts or omissions, unless directly caused by our negligence.
By booking with us, you acknowledge that eco-tourism and wildlife travel involve inherent risks, including:
Unpredictable weather or terrain,
Interaction with wildlife,
Transportation delays, or
Limited medical facilities in remote areas.
Participants must follow safety instructions from guides and suppliers at all times.
We expect all travelers to:
Respect local customs, wildlife, and communities.
Avoid behaviour that causes offense, risk, or damage.
We reserve the right to remove any participant for unacceptable conduct without refund.
Any optional activities or excursions booked independently (not through Flora & Fauna) do not form part of your contract with us.
We are not responsible for their performance, safety, or quality.
If a problem arises during your trip:
Inform your tour guide or local representative immediately so corrective action can be taken.
If unresolved, submit a written complaint to info@florafaunatravels.com within 28 days of return.
We will investigate promptly and attempt amicable resolution.
We will not be liable or pay compensation for failure to perform contractual obligations due to events beyond our control, including but not limited to:
Natural disasters, extreme weather, pandemic, war, civil unrest, strikes, government restrictions, or supplier insolvency.
Where possible, we will offer alternative arrangements, but no refunds or compensation will be made for expenses beyond our control.
We collect and process personal data in accordance with our Privacy Policy.
By booking with us, you consent to:
The use of your personal data for booking, payment, and communication purposes; and
Data sharing with third-party suppliers (hotels, transport, payment gateways, marketing partners) as necessary to fulfil your booking.
All text, photographs, graphics, and designs on www.florafaunatravels.com are the property of Flora & Fauna or its licensors.
You may view and print content for personal use but may not copy, distribute, or reproduce it for commercial purposes without written consent.
We make reasonable efforts to ensure information accuracy but accept no liability for typographical errors or omissions.
Flora & Fauna is committed to responsible and ethical tourism.
By booking with us, you agree to:
Follow local conservation and wildlife-watching guidelines,
Minimize waste and environmental impact, and
Respect community-based tourism principles.
We reserve the right to exclude individuals who disregard these principles.
Our liability is limited to the price paid for your booking. We are not liable for indirect or consequential losses, such as missed connections, delays, or enjoyment loss, unless required by law. Nothing in these Terms excludes liability for death or personal injury caused by our proven negligence.
These Terms are governed by and construed in accordance with the laws of Sri Lanka, and any disputes will be subject to the exclusive jurisdiction of the courts of Sri Lanka.
We may revise these Terms from time to time to reflect operational, legal, or regulatory changes. Updated versions will be posted on our Website with a new “Last Updated” date. Continued use of our services after such updates constitutes acceptance of the revised Terms.
